A Lawyer’s Blog – Jon Michael Probstein, Esq.: NY CUSTODY

This case is a reminder for me of the salient issue in my school CRA cases in MA. CK v. LK, 2025 NY Slip Op 50992 – NY: Supreme Court, Richmond 2025: “This matrimonial action was commenced on XX XX, 2024. The parties were married on XX XX, 2006, and there are two unemancipated children…

The Case for Mandatory Insurance – Lash Condo Law

Shared amenities like party rooms enhance condominium living by providing spaces for social gatherings. However, on occasion, events in the amenities can give rise to potential liability concerns. For condominium corporations, implementing clear rules governing use of the party room and mandating insurance coverage for party room rentals is one way to help mitigate some…

Canada’s DST Debacle a Case Study of Digital Strategy Trouble

My Globe and Mail op-ed opens by noting that after years of dismissing the warnings of likely retaliation, the Canadian government caved to U.S. pressure earlier this week as it cancelled the digital services tax. Faced with the U.S. suspension of trade negotiations, Finance Minister François-Philippe Champagne announced that the government would rescind the legislation that…

Can A Buyer Back Out of a Non-Contingent Offer?

In my last article, we discussed liquidated damages in the context of a residential real estate purchase contract.  This article will examine whether a buyer may have a right to back out of a contract and receive their full deposit back, after contingencies are released. In our thriving real estate market, non-contingent offers are increasingly…

1. An Omni-Crisis in International Law: Iran, Israel and Gaza. The Transitional Justice Institute at Ulster University is hosting an online discussion on the current omni-crisis in international law – with Prof. Marko Milanovic from Reading University, Susan Power from Al Haq, Palestinian lawyer Sahar Francis, and Dr. Thomas Hansen and Dr. Roua Al Taweel from Ulster University – 8 July, 6.30pm to 8pm (UK time). Twenty-four UN experts have condemned Israel’s attacks on Iran on 13 June as ‘a flagrant violation of fundamental principles of international law, a blatant act of aggression and a violation of jus cogens norms.’ A range of lawyers increasingly use the language of genocide to describe Israeli policy in Gaza. But the Israel-Iran conflict has taken the focus off Palestine. Join the discussion by signing up via Eventbrite here.
